The legal notice informs, in a concise way, of the main aspects of the digital participation platform Participa311 Castellví de Rosanes, promoted by the City Council of Castellví de Rosanes with the support of the Barcelona Provincial Council (Management of Equality and Citizenship Services, Area of Attention to People). The platform aims to promote citizen participation and direct, deliberative and participatory democracy in the municipality through the different processes, spaces and bodies of participation, generating forms of direct and open interaction between the City Council and citizens and entities in general. Participa311 Castellví de Rosanes is aimed at promoting deliberation and debate, transparency and traceability of participation (in no case to trace users), and the generation of face-to-face and digital spaces for participation.
Users are obliged to make diligent use of them and in accordance with this objective.
General aspects of participation in the platform
The City Council is not responsible for the incorrect use of this platform by users or the content they provide. Each user is responsible for using the platform correctly and for respecting the other people, entities and groups involved. Any participant is also responsible for the legality of the content they have shared on the platform.
Castellví de Rosanes Town Council is not responsible for the quality, originality, authenticity, legality or safety of the content that users contribute to the platform.
However, Castellví de Rosanes City Council reserves the right to remove from the platform opinions, information, comments, proposals or files that contradict these conditions of use and the legal notice, and may install filters for this purpose. All this will be done solely with the aim of preserving the fundamental objective of the Participa311 Castellví de Rosanes platform.
The City Council of Castellví de Rosanes also reserves the power —without any prior notice— to temporarily suspend the activities of a participant in the platform, deactivate the account in any way, delete its content, delete the account or send a notice, especially, and without limitation, in the following cases: if there is an infringement of these conditions of use of the participation platform and if the City Council believes that the activity of the participant is harmful to others, to the website or to the City Council.
The participant is responsible for the content of their contributions and for any damages or claims from third parties that may arise from them.
In summary, the people who access this platform undertake to accept and comply with all the provisions of the legal notice and all the applicable provisions.
They also undertake to make lawful and appropriate use of the contents and services and to refrain from any illegal conduct or conduct contrary to good faith.
Basic information on data protection
Data controller: Castellví de Rosanes City Council
Purpose of the processing: to manage contact with citizens and people interested in participating more actively in the municipality, including the opinions of users who may publish them.
Legal basis for the processing: the processing is necessary for the fulfilment of a mission carried out in the public interest or in the exercise of public powers. In those treatments that require it, it may be based on the consent of the user.
Recipients of the data: they will not be communicated to third parties except for legal obligation.
