The platform aims to promote citizen participation and direct, deliberative and participatory democracy in the municipality through the different processes, spaces and bodies of participation, generating forms of direct and open interaction between the City Council, citizens, and the different social agents of the municipality and is aimed at promoting citizen deliberation and debate, transparency and traceability of participation (in no case to trace users), and the generation of face-to-face and digital spaces for participation.

Citizens who access this platform undertake to accept and comply with all the provisions of the legal notice, the terms and conditions of use and all applicable provisions. It also undertakes to make lawful and appropriate use of the contents and services and to refrain from any illegal conduct or conduct contrary to good faith.

The platform is managed by the City Council of Castellví de Rosanes and has the technological and technical support of the Barcelona Provincial Council.

Scope of these terms of use

The following terms of use for participation in the platform are binding on all persons participating in this website. At the time of registration, you will be asked to accept these conditions.

Castellví de Rosanes City Council reserves the right to modify the current conditions for the platform and will publish the latest version of these conditions on this website. In order to stay informed of future changes, we advise you to visit this page from time to time.

Users will be informed of the modifications when they affect their privacy and/or security.

Aim of Participa311 Castellví de Rosanes

The platform aims to promote citizen participation and direct, deliberative and participatory democracy in the municipality through the different processes, spaces and bodies of participation, generating forms of direct and open interaction between the City Council and citizens and entities in general. Participa311 Castellví de Rosanes is aimed at promoting deliberation and debate, transparency and traceability of participation (in no case to trace users), and the generation of face-to-face and digital spaces for participation.

In this way, it seeks to face the challenges and difficulties that arise in our municipality with the aim of improving it, and extending tools for participation and direct democracy to all citizens through multiple processes, spaces, bodies and other forms of citizen participation.

The City Council opts for a participatory, direct and deliberative democracy, making visible and promoting initiatives that, both individually and collectively, can contribute to debating, designing and/or valuing municipal and citizen actions in favour of the common good.

The platform also aims to facilitate and make visible the debates, design, assessment, negotiation and modification, monitoring, and evaluation of public policies that may be carried out outside the platform, in order to offer citizens maximum transparency.

General aspects of participation in the Participa311 Castellví de Rosanes platform

Any individual from the age of 16 who has previously registered on the platform can participate. By accepting these Terms of Use, the registered person declares that he/she is 16 years of age or older. The adults on whom minors depend are responsible for the actions of these minors on the platform.

The platform also allows the possibility of opening the register to entities, collectives, groups and/or citizen organizations and relevant actors in the municipality.

As the Participa311 Castellví de Rosanes platform is a meeting point that aims to promote citizen participation in a framework of coexistence, cooperation and respect, users are obliged to make diligent use of it and in accordance with this objective.

Castellví de Rosanes City Council is not responsible for the incorrect use of the Participa311 Castellví de Rosanes platform by users or the content they provide. Each user is responsible for using the platform correctly, as well as for the legality of the content and opinions they have shared.

It is not allowed to add any illegal or unauthorized content to the website, such as information that has the following characteristics:

• That it is false or misleading.

• That it violates an applicable law or regulation.

• That infringes any right of the City Council or any third party, such as copyright, registered trademarks or other intellectual and industrial property rights or other related rights.

• That violates the privacy of a third party, such as publishing personal details of the participants, such as name, address, telephone number, email, photographs or any other personal information.

• That it contains viruses, Trojan horses, robots or other programs that may damage the website or systems of the City Council or the website or system of any third party, or that are intended to circumvent the technical measures designed for the proper functioning of the platform.

• That it intends to spam users or overload the system.

• That it has the character of a chain of messages, a pyramid game or a game of chance

• That it has commercial purposes, such as publishing job offers or advertisements;

• That it is not in accordance with public decency; consequently, the content must not incite hatred, discriminate, threaten, provoke, or be sexually meaningful, violent, rude, or offensive; that violates an applicable law or regulation

• To carry out campaigns promoting mass voting for other proposals unrelated to the process and the debate framework, and to create multiple users by pretending to be different people (astroturfing).

Castellví de Rosanes Town Council is not responsible for the quality, originality, authenticity, legality or safety of the content that users contribute to the platform.

However, Castellví de Rosanes City Council reserves the right to remove from the platform opinions, information, comments, proposals or files that contradict these conditions of use, and may install filters for this purpose. All this will be done solely with the aim of preserving the fundamental objective of the Participa311 Castellví de Rosanes platform.

The City Council of Castellví de Rosanes also reserves the power —without any prior notice— to temporarily suspend the activities of a participant in the platform, deactivate the account in any way, delete its content, delete the account or send a notice, especially, and without limitation, in the following cases: if there is an infringement of these conditions of use of the participation platform and if the City Council believes that the activity of the participant is harmful to others, to the website or to the City Council.

The participant is responsible for the content of their contributions and for any damages or claims from third parties that may arise from them.

The City Council of Castellví de Rosanes will not be responsible, under any circumstances, for the improper use of the site of the platform or the contents that are shared on it, nor will it be responsible for the use that a natural person makes of the ideas contributed, nor for the suitability of these ideas, nor for the results that derive from them.

In the event that the content includes a link to another website, Castellví de Rosanes Town Council does not assume any type of responsibility for damages and/or losses due to access to the contents of this link, nor for the content that may be contained in this same link.

In the event of a dispute of any kind or for any reason between the participants on the website or in a third party, Castellví de Rosanes City Council is exempt from any liability for claims, demands or damages of any nature that are related in any way to this dispute.

How the platform works

People can access and browse the Participa311 Castellví de Rosanes platform freely and anonymously.

Only those who want to carry out any action that involves creating, supporting or commenting on a proposal or participating in a debate will need to register in advance.

The registration that will allow you to participate in the platform in the different modalities provided and after indicating the details of username, email, password. You will have to accept the terms of use.

The user will be required to verify their account confirming that they are 16 years of age or older and that they are registered in Castellví de Rosanes. To this end, three data relating to the census (ID card, postal code and date of birth) will be requested. The verification is carried out by verifying the registration status with the information held by the City Council, in accordance with the regulations applicable to the administrative and data protection procedure. Information on the processing is provided in layered information format and access to complete information in the data protection policy

The platform also allows the possibility of registering entities, groups and/or organisations, in which case, the following data will be requested: name of the organisation and NIF, representative and NIF, email, telephone, password and acceptance of the terms of use.

The registered person can interact with the platform through the different functionalities enabled by each of the participation processes. The verified person will be able to support the proposals and participate in the processes of prioritizing them.

Conditions for the processing of content provided by users

These terms and conditions regulate the terms applicable to the content sent by users of this platform through the corresponding form (hereinafter, the "Content").

The content does not include personal data (except the user's public name) that are provided at the time of registration and verification, it only includes the public content provided by the user (comments, proposals,...).

These conditions apply both to the content initially sent to the Participa311 Castellví de Rosanes platform and to any content that is subsequently sent or manifested to the Castellví de Rosanes Town Council:

Non-confidentiality: All content sent by the user to Castellví de Rosanes Town Hall must be capable of being known to the general public. Therefore, the City Council of Castellví de Rosanes will treat said content as non-confidential information.

Procedure: In the event that the City Council of Castellví de Rosanes is interested in the content sent by the user, it may contact it to request additional information, without the City Council acquiring -for this fact- any commitment with respect to the user.

This information will be non-confidential, without prejudice to the fact that, in the event that the parties consider the need to exchange confidential information, a confidentiality agreement will be signed.

All this without prejudice to the provisions of the section relating to "Intellectual and industrial property rights".

Publicity or dissemination of the contents presented: the participants in the Participa311 Castellví de Rosanes platform declare that they are aware of and accept the fact that the information provided may be published on the websites owned by the City Council of Castellví de Rosanes, as well as through other means that the organization considers appropriate to publicize this initiative.

Intellectual property: unless otherwise indicated, the contents protected by the intellectual property that the user contributes to this website will be subject to a Creative Commons - Attribution - Non-Commercial - Share Alike (CC-BY-NC-SA) license.

Notice and withdrawal procedure: any person, with reasoned reasons, may request the removal of content that does not comply with the legal notice and the conditions of use in this case.
